Omnithru Freeware License

Free to use, also for work: in the studio, on stage or in teaching. Not open source: you may not modify it, redistribute it or offer it as a service to others.

Version 1.0 · Draft · © 2026 Francesco Laguardia. All rights reserved.

The English text is the binding version. Read the Italian courtesy translation.

"Omnithru" (the "Software") means this program, its source code, its documentation and its artwork (logo, icons, interface design).

1Grant of use

The author grants you a free, non-exclusive, non-transferable licence to install and run the Software, unmodified, on devices you own or control, for any lawful purpose, personal or commercial (for example in your studio, on stage or in teaching). You may make backup copies for your own use. Changing the documented configuration (such as environment variables, or interfaces saved from the Controller Builder) is not a modification of the Software.

2What you may not do

Without the author's written permission you may not:

  1. modify, adapt, translate or create derivative works of the Software;
  2. copy, publish, distribute, sell, rent, lend or sublicense the Software or any part of it;
  3. offer the Software to third parties as an online or hosted service;
  4. remove or alter copyright notices or the name and logo of the Software;
  5. reverse engineer, decompile or disassemble the Software, except to the extent that applicable law allows it despite this restriction;
  6. use the name "Omnithru" or its logo to identify other products or services.

3Ownership

The Software is licensed, not sold. The author keeps all copyright and other intellectual property rights. No right is granted except those stated in this licence. Feedback you send may be used by the author freely.

4Third-party components

The Software uses components that belong to other people and are licensed under their own terms (see third-party components). This licence does not change those terms.

5No warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. MIDI messages can reach real instruments and equipment: you are responsible for how you use the Software.

6Limitation of liability

To the maximum extent permitted by law, the author is not liable for any damage arising from the use of, or the inability to use, the Software. Nothing in this licence excludes liability that cannot be excluded by law.

7Termination

This licence ends automatically if you breach it. You must then stop using the Software and delete your copies. Sections 3, 5, 6 and 8 survive.

8Governing law and jurisdiction

This licence is governed by and construed in accordance with Italian law. If you are acting as a commercial entity or professional user (B2B), any dispute arising out of or in connection with this licence shall be subject to the exclusive jurisdiction of the Courts of Milan, Italy. If you are acting as a consumer (B2C), applicable statutory consumer protection laws regarding mandatory jurisdiction shall apply. If any provision of this licence is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Third-party components

Omnithru uses these components, each under its own licence (MIT, or BSD-3-Clause for node-forge). The downloadable app includes Node.js; its full licence text ships with the app in legal/NODEJS-LICENSE.txt. This notice does not change their terms.
